Aufenthaltsrecht durch Ausbildung – Zum Ende und Neuanfang der sog. Ausbildungsduldung

Abstract

„Im Rahmen der Reform des Fachkräfteeinwanderungsrechts 2023 sollte die Ausbildungsduldung abgeschafft werden. Der Gesetzgeber hat mit § 16 g AufenthG für diese besondere Spurwechseloption zugunsten ausreisepflichtiger Ausländer, die eine betriebliche Ausbildung absolvieren, einen regulären Tatbestand zur Erteilung einer entsprechenden Aufenthaltserlaubnis geschaffen. Gleichzeitig wurde das Institut der Ausbildungsduldung aber dann doch als Auffangregelung erhalten. „In the context of the reform of the legal provisions concerning skilled labour migration (2023) the so-called Ausbildungsduldung (temporary suspension of deportation for the purpose oftraining) was determined to be abolished. The legislator has now created a provision for theregular issuing of a residence title for foreigners who are obliged to leave the federal territorybut are doing a vocational training. At the same time however, the Ausbildungsduldung hasbeen upheld to serve as a hold-back regulation.
